Assault charges are taken extremely seriously in Washington state. The same is true here in Seattle and throughout King County.  The police and prosecutors vigorously pursue every allegation physical assault.  In addition to facing significant jail time, an assault conviction can have many unfortunate and negative consequences on your life.

Degrees of Assault in WA State.
There are four "degrees" of assault in Washington state. For charging purposes, the degree is primarily related to the alleged level of force used and the alleged injury suffered by the victim. 

Misdemeanor Assault in Washington State (Fourth Degree).
If no significant injury is caused to the other person, it will most likely be charged as Assault in the Fourth Degree, which is a gross misdemeanor.  Gross Misdemeanors in WA State are punishable by up to a year in jail and $5,000 fine.  In the majority of cases where medical treatment is not necessary, the person will be charged with 4th Degree Assault.


Felony Assault in WA State (1st, 2nd ,and 3rd Degrees).
If the assault results in physical injury and requires medical care, it is referred to as aggravated or felony assault.  There are three degrees of Felony Assault here in Washington: First Degree (the most serious); Second Degree, and Third Degree. Each degree has its own unique elements but the critical distinction is basically the amount of forced used and amount of harm inflicted.
